When Snow And Ice Lead To Accidents

Treetops glisten with a fresh layer of snow, as icicles drip, drip, drip across the city.  If we could all sit inside and admire the winter through our windows while sipping hot cocoa, wouldn’t it be wonderful! Unfortunately, most of us find ourselves out in the weather, whether it’s because we have to drive to work or because we have to walk to a bus stop. And when the roadways and sidewalks are covered in ice and snow, it’s dangerous to be out!

Code Blue

Maryland has seen more than a few Code Blue days already this season—times when wind chill temperatures fall below 13 degrees. In addition to frostbite and hypothermia, many have a difficult time removing snow and ice from walkways around their homes. Nevertheless, the responsibility to maintain clear walkways remains for residents and businesses alike.

Premises Liability

In Maryland property owners are expected to clear sidewalks within a reasonable period after a snowstorm. Failure to do so could result in a slip and fall accident, for which the property owner would be held liable. Commercial businesses are held to an even higher standard and must address unsafe conditions immediately.

Roads

While residents are not responsible for the roadways, they certainly have a stake in how well wintery roads are maintained. Snowplow operations generally take care of heavily trafficked roads first, heading into neighborhoods and side roads later on. In one recent storm, more than 95 calls for tow service occurred in just one area. Some of the calls were related to accidents, though many were also because people were stuck. In either situation, the danger of injury is very real.  If you can demonstrate that your injuries were the result of reckless or negligent driving of another motorist, they may be liable for your injuries.

When Seeking Damages

After an accident in which you may later choose to seek damages, it’s a good idea to document what happened as soon as possible.  Pictures, witness statements, and a contemporaneous journal of everything related to the accident is always a good idea. When you connect with an experienced local personal injury attorney, they will help you collect other documentation, including police reports, medical bills, estimates of lost wages, and more. All of this will contribute to your chances of collecting a settlement to help with your expenses going forward. One caveat: because Maryland is a contributory negligence state, if you are even partly to blame for the accident, you could lose the right to collect any damages.
